{"id":2021,"date":"2014-10-01T00:00:00","date_gmt":"2014-10-01T00:00:00","guid":{"rendered":"https:\/\/multiacademstg.wpengine.com\/14001academy\/blog\/2014\/10\/01\/demystification-legal-requirements-iso-14001\/\/"},"modified":"2026-07-30T09:30:08","modified_gmt":"2026-07-30T09:30:08","slug":"demystification-legal-requirements-iso-14001","status":"publish","type":"post","link":"https:\/\/advisera.com\/14001academy\/blog\/2014\/10\/01\/demystification-legal-requirements-iso-14001\/","title":{"rendered":"Demystification of legal requirements in ISO 14001"},"content":{"rendered":"<p><em>Updated on July 30, 2026, to reflect the 2026 revision of ISO 14001.<\/em><\/p>\n<p>Almost all organizations implementing <a href=\"https:\/\/advisera.com\/14001academy\/what-is-iso-14001\/\" target=\"_blank\" rel=\"noopener noreferrer\">ISO 14001<\/a> are<\/p>\n<p>aware that legal requirements are the foundation and basic requirements of ISO 14001. But, if you ask somebody to explain precisely what <em>legal requirements compliance<\/em> means in the context of ISO 14001, you will receive very few answers.<\/p>\n<p>ISO 14001 is not very helpful, either \u2014 its clause 3 \u201cTerms and definitions\u201d has no definition for legal requirement compliance, and the requirements include these along with other requirements under the term \u201ccompliance obligations.\u201d Principles of Environmental Enforcement (Implementation and Enforcement of Environmental Law (IMPEL), 1992) have defined legal compliance as: \u201cFull implementation of applicable environmental legislation. Compliance occurs when requirements are met and desired changes are achieved.\u201d<\/p>\n<p>On the other hand, ISO 14001 does state that an organization is required to identify and have access to all applicable legal requirements related to its environmental aspects. These requirements must be taken into account when the organization establishes and maintains its Environmental Management System (EMS).<\/p>\n<h2>Steps for compliance with legal requirements<\/h2>\n<p>So, let\u2019s see what <em>legal requirement compliance<\/em> in ISO 14001 is all about.<\/p>\n<h3><strong>1. Environmental policy<\/strong><\/h3>\n<p>As mentioned above, compliance obligations are defined as legal and other requirements, which would have been identified in clause 4.2, Understanding the needs and expectations of interested parties. The <a href=\"https:\/\/advisera.com\/14001academy\/iso-14001-documentation-toolkit\/?rel=policy-and-manual&amp;doc=environmental-policy\" target=\"_blank\" rel=\"noopener\">Environmental Policy<\/a> should reflect the commitment of top management to comply with applicable legal requirements and other requirements, supported by adequate resources. This commitment is usually in the form of a simple statement, whereas the identification of those requirements is explained in the next section.<\/p>\n<p><em>Other requirements<\/em> are voluntary initiatives the organization chooses to comply with (e.g., UN Global Compact, a strategic policy initiative for businesses).<\/p>\n<h3><strong>2. Compliance obligations <\/strong>(6.1.3)<\/h3>\n<p>Clause 6.1.3 of ISO 14001 states that the organization should know applicable compliance obligations related to their activities and services.<\/p>\n<p>The organization may find environmental regulations on the websites of government agencies in charge of environmental protection, or on other specialized services. In a wide list of regulations, you should choose only those that are applicable to your business. (E.g., if you manage heating boiler power above 100kW, then you are subject to the measurement of emissions from stationary sources. Or here\u2019s another example related to water use: If you use water only for sanitary purposes, you don\u2019t need to have a water license.) Sometimes an organization will outsource these activities to external service providers.<\/p>\n<p><div id=\"middle-banner\" class=\"banner-shortcode\"><\/div><script>loadMiddleBanner();<\/script><br \/>\n<div id=\"side-banner-trigger\" class=\"banner-shortcode\"><\/div><\/p>\n<h3><strong>3. The environmental objectives (6.2.1)<\/strong><\/h3>\n<p>ISO 14001, in its 6.2.1, states that when an organization establishes environmental objectives, it should take into account its <em>legal<\/em> and other requirements.<\/p>\n<p>The organization should plan how to comply with compliance obligations. If, during identification of applicable legal requirements, you find that you are partially in compliance with a specific applicable regulation, or that you have completely ignored it, now is the time to set it as a target (e.g., to comply with the directive on measuring emissions from a stationary source, in case you manage a boiler with power above 100kW).<\/p>\n<p>In the implementation phase, the organization should have instruments in place for dealing with legal requirements (e.g., sufficient documents to demonstrate compliance, responsibilities and authorities for compliance-related requirements, compliance-related communication processes, training and awareness of the compliance-related processes).<\/p>\n<h3><strong>4. Evaluation of compliance<\/strong> (9.1.2)<\/h3>\n<p>Periodic evaluation of compliance is important because, even if your organization is in compliance today, you cannot be sure that it will be in compliance in six months or a year. For example, if \u201cDirective on measuring emissions from a stationary source\u201d is applicable for your organization, you should check, e.g., yearly, if the authorized service measures exhaust gases and whether the test result is below the legal limits.<\/p>\n<p>Where a non-compliance with legal requirements is discovered (e.g., results of measuring exhaust gases are outside the legal limit), the organization is required to take immediate corrective action (e.g.,\u00a0adjust the parameter of the boiler and repeat measurements, including root cause analysis, correction, and measures to prevent recurrence), which may include actions to immediately inform the environmental regulator, depending on the specific legal requirements and magnitude of the non-compliance.<\/p>\n<h3><strong>5. Management review<\/strong> (9.3)<\/h3>\n<p>Clause 9.3 requires top management, through the management review process, to review the results of evaluation of compliance and possible changes in compliance obligations<em>. <\/em>This is to ensure that top management are aware of the risks of potential or actual non-compliance, and that they have taken appropriate steps to meet the commitment to legal compliance.<\/p>\n<p style=\"padding-top: 10px; padding-bottom: 5px;\"><img decoding=\"async\" class=\"aligncenter size-full wp-image-12895\" src=\"\/wp-content\/uploads\/\/sites\/4\/2014\/10\/legal-14001-article.png\" alt=\"Steps for compliance with legal requirements\" width=\"1000\" height=\"530\" srcset=\"\/wp-content\/uploads\/sites\/4\/2014\/10\/legal-14001-article.png 1000w, \/wp-content\/uploads\/sites\/4\/2014\/10\/legal-14001-article-300x159.png 300w, \/wp-content\/uploads\/sites\/4\/2014\/10\/legal-14001-article-768x407.png 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p>Taken together, these provisions mean that an organization implementing ISO 14001 should systematically identify and manage its compliance obligations by including the elements listed above within its Environmental Management System.<\/p>\n<p>There have been many examples of organizations that have reached and maintained their legal compliance as a result of implementing and maintaining an EMS that conforms to the standard \u2014 while certification of an EMS against the requirements of ISO 14001 is not a guarantee of legal compliance, it is a proven and efficient tool to achieve and maintain such legal compliance.<\/p>\n<p><em>To implement ISO 14001 easily and efficiently, use our<\/em> <a href=\"https:\/\/advisera.com\/14001academy\/iso-14001-premium-documentation-toolkit\/\" target=\"_blank\" rel=\"noopener\">ISO 14001 Premium Documentation Toolkit<\/a> <em>that provides step-by-step guidance and all documents for full ISO 14001 compliance.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Updated on July 30, 2026, to reflect the 2026 revision of ISO 14001.
